Two appeals filed by C.A.R.E.S.


C.A.R.E.S. has filed an appeal before the Zoning Board of Appeals to reverse the Building Inspector's decision that the Shott application was complete when submitted on July 2, 2001. Shott failed to meet with the Planning Board in a pre-submission conference prior to submission. The pre-submission conference is when the Planning Board has the opportunity to require additional information of an applicant. The Planning Board did not have this opportunity. Accordingly, certain pertinent information, such as right of way disputes on both sides of the property, were not brought to the Planning Board's attention.

C.A.R.E.S. would like to ensure that in addition to the Shott application, all future special use permits follow the process set out in zoning law. CARES has also filed a question of interpretation before the Zoning Board of Appeals asking the ZBA to find that the determination to forgo lead agency status under SEQR was an "offical action" of the Planning Board, which according to town zoning law required a concurring vote of a majority of the Board. Such a vote never took place. Although it may not be possible to re-establish lead agency in the case of the Shott proposal, CARES seeks to ensure that future decisions by the Planning Board on lead agency status are done in a public and democratic way. ----

C.A.R.E.S.will be having a member-wide yard sale at the Elks pavilion on Rt. 32 on Oct. 6 from 9a.m. until 4p.m. We need your donations; now is the time to clean out your attics and cellars for the cause. You can deliver your donations at 7:30 that morning; if possible, price your items. No clothing, used computers, or books, please. We will also be selling refreshments.
